2. Data collected

• Identification data: surname, first name, email address, telephone number, company name, trade name, postal or billing address.
• Professional data: business sector, type of company, information relating to the activity, communication needs, content preferences.
• Payment data: transaction ID, payment status, billing address, information required for invoicing via Stripe or any other payment provider used.
• Technical & usage data: IP address, browser, device used, pages visited, interactions with the site, forms completed, audience measurement data when the relevant tools are activated.
• Support data: messages, requests, client exchanges, attachments, comments or information transmitted as part of a commercial request or client follow-up.
• Content provided by the client: photos, videos, logos, texts, brand elements, news, offers, promotions, product or service information, and possible access to social accounts when the offer includes content scheduling or publishing.

PUBLIAU LLC does not knowingly collect data relating to persons under the age of 18.

The services offered by PUBLIAU LLC are intended exclusively for professionals acting within the scope of their commercial, craft, independent or liberal professional activity.

3. Content provided by the client & intellectual property

As part of the content creation services, the client may provide photos, videos, logos, texts, musical references, commercial information, news, promotional elements or any other communication material.

When the subscribed offer includes content scheduling or publishing, the client may also be required to provide access, authorizations or connections to their accounts, pages or social profiles.

The client guarantees that they hold all the rights, authorizations and licenses required to transmit, use and exploit such content.

PUBLIAU LLC may not be held liable in the event of any claim, dispute or infringement of intellectual property rights, image rights, music rights, trademark rights or third-party rights relating to elements provided by the client.

Media content transmitted by clients may be temporarily stored, processed or transferred via technical providers used for the creation, editing, delivery, hosting, storage, scheduling, publishing or communication of digital content.

Depending on the needs of the service, certain content may be processed, adapted, enriched or optimized using artificial intelligence tools, graphic creation tools, video editing tools or automation tools used by PUBLIAU LLC.

4. Purposes & legal bases (Article 6 GDPR)

• Managing contact requests, quotes, calls or commercial exchanges → legitimate interest or pre-contractual measures.
• Processing orders and delivering services → performance of a contract.
• Creating, adapting, editing and delivering digital content → performance of a contract.
• Scheduling or publishing content on the client’s accounts when provided for in the offer → performance of a contract.
• Invoicing, accounting and tax obligations → legal obligation.
• Client support, commercial follow-up and service-related communication → legitimate interest.
• Website security, abuse prevention and technical statistics → legitimate interest.
• Newsletter, commercial prospecting or marketing communications → consent where required, or legitimate interest where permitted by applicable regulations.

5. Recipients & providers

Data may be transmitted only to the persons and providers necessary for the performance of the services, including:

• Stripe or any other payment provider used for the management of payments, subscriptions and invoices.
• Systeme.io for hosting pages, forms, funnels, order areas or automations.
• OVH for domain name management where applicable.
• Google or similar tools for emails, files, statistics, forms or shared documents when these tools are used.
• Technical providers used for content creation, file storage, document sharing, editing, hosting, scheduling, publishing, communication or delivery of content.
• Artificial intelligence, graphic creation, video editing or automation tools used to produce, adapt, improve or deliver the content ordered by the client.
• Social platforms or scheduling tools when the client authorizes PUBLIAU LLC to schedule or publish content on their accounts.

Data is not sold to third parties.

6. Retention periods

• Invoices, orders and accounting documents: 10 years.
• Client exchanges, support and commercial follow-up: 3 years after the last interaction.
• Inactive prospects: 3 years after the last contact or last interaction.
• Technical and security logs: 12 months, unless a specific need requires otherwise.
• Media content and client files: retained for the time necessary to perform the service, unless longer retention is required for follow-up, support, proof of delivery, legal obligations or the company’s legitimate needs.
• Access or authorizations to social accounts: retained only for the time necessary to perform the relevant service, unless there is a contrary obligation or necessity.

7. Your rights

In accordance with the GDPR where applicable, you may request access to, rectification, deletion, restriction, objection to processing, or portability of your personal data.

To exercise your rights, you may send a request to info@publiau.com. Proof of identity may be requested in the event of reasonable doubt regarding your identity.

A response will be provided within a reasonable timeframe, and in principle within 30 days where the GDPR is applicable.

In the event of a complaint, you may contact the competent supervisory authority. In France: the CNIL (cnil.fr).

No profiling or automated decision-making producing legal effects is carried out.

PUBLIAU LLC implements reasonable technical and organizational measures to protect the data processed, including secure access, restricted access to client files, enhanced authentication where available, secure payment tools, protected backups where applicable, and the use of recognized providers.

The client remains responsible for the security of their own accounts, passwords, access to social networks, professional pages and third-party tools that they use.

Certain processing may take place outside the European Union, in particular in the United States, through tools used for payment, hosting, statistics, communication, content creation, file sharing, scheduling, publishing or service delivery.

Where necessary, these transfers are based on appropriate safeguards, including the European Commission’s Standard Contractual Clauses, the EU-U.S. Data Privacy Framework where applicable, or any other mechanism recognized by applicable regulations.

The data collected and processed is used to perform the services offered, and not to guarantee measurable performance on social platforms or digital channels.
